ANNEX B to Common Constitution
1: In the event of any player or players being reported for bad behaviour, a written report shall be submitted to the Leagues Hon Secretary by the Complainant so that it is received by the Chairman of the Disciplinary Committee by the Tuesday following the incident. The report must contain :-
a) all factual information in relation to the incident
b) confirmation that the player or players reported have been advised of that facts.
c) confirmation that the two captains on the day have also been told of the report & the player(s) involved
d) any other information considered relevant by the Complainant
2: If the Chairman of the Disciplinary Committee is of the opinion that the conduct described in the Complainants report is so serious that sanctions other than those contained within the VCC should be considered, the Chairman shall forthwith write to the two captains on the day requesting a written report with regard to the incident. Such report must be sent to the Leagues Hon Secretary so that it is received by him no later than the Monday following his receipt of the Complainants report.
3: The Disciplinary Committee shall sit to consider the reports of the Complainant and the captains no later than 14 days after the incident. The Committee shall have the power to pass the following sanctions:-
a) a player or players may be suspended from playing in the Kent Cricket League (countywide or the regional leagues) for any period of time as considered appropriate. There shall be no limit to this power.
b) the imposition of a fine, to a maximum of £1,000, on any Club who has a player suspended
4: Any suspension imposed by the DC shall be over and above the suspension already in place by virtue of the VCC
5: When a player is suspended by the DC, that body shall notify the player and his Club within 14 days of the date of that Committees meeting.
6: When the DC imposes a fine upon a Club, the Chairman of that Club shall be notified of the fine within 14 days of the date of that Committees meeting.
7: No Club shall have the right of appeal against any fine imposed by the DC.
8: A player suspended by DC shall have no right of appeal against such suspension, save only as mentioned in para 9 below
9: If a player is suspended for a period greater than 6 weeks, not including any suspension imposed under the terms of the VCC, that player or his Club shall have the right of appeal against suspension but only insofar as it relates to that part of the suspension which is greater than 6 weeks, excluding any suspension imposed under the VCC.
10: Any appeal lodged pursuant to para 9 above shall only be an appeal against the length of the suspension
NOTE:
A: The Complainant shall be an Umpire officiating in the relevant game or the Chairman of one of the Clubs involved in that game. In the absence of the Chairman, an Officer of that Club may substitute who shall be neither a captain of any side within the Club nor a player in the relevant game
B: The Disciplinary Committee shall comprise four persons from the Leagues Executive Committee, one of whom shall serve as chairman.
1: If any player suspended by the Disciplinary Committee, or the Club of any player so suspended, has a right of appeal against that suspension, then the following procedure shall be adopted:-
1.1 Within 7 days of the receipt of the letter notifying the details of the suspension, the player or his Club shall lodge a letter of appeal together with a fee of £50. The letter and fee shall be sent to the Leagues Hon Secretary. The Disciplinary Committee reserve the right to reject any such appeal that is not lodged within those 7 days.
1.2 Upon receipt of a letter of appeal, the Chairman of the Disciplinary Committee shall cause the Appeal Committee to meet within 21 days of the date that the appeal letter was received by the Leagues Honorary Secretary.
1.3 The Appeal Committee shall have no power to increase the suspension imposed by the DC. The Appeal Committee shall only have the power to either refuse the appeal or lessen the period of suspension. The Appeal Committee has no power to interfere with any automatic suspension by virtue of the VCC.
1.4 In the event that an appeal is successful, either wholly or in part, the Appeal Committee shall have the discretion to refund some or all of the appeal fee of £50. Any decision in relation to this matter made by the Appeal Committee shall not be the subject of further appeal.
1.5 The player who is the subject of the appeal may attend the Appeal Committee hearing in person and he shall be allowed to address that committee in person, by way of mitigation. If the appeal is lodged by the Club, then it shall have the right to send an official to address the committee by way of mitigation. Any such mitigation presented in either fashion to the Appeal Committee shall only address the issue as to why the suspension should have been for a shorter period.
1.6 The Appeal Committee shall forward its findings in writing to the Club and to the player within 7 days of the date of the hearing.
2: The Appeal Committee shall not contain any person who is a member of the Executive Committee of the League. The Appeal Committee shall consist of four persons selected from the Regional Management Group, one of whom shall serve as Chairman.
